The California Transparency in Supply Chains Act of 2010 (SB 657) requires certain companies manufacturing or selling products in the State of California to disclose their efforts (if any) to eradicate forced labor and human trafficking from their direct supply chains for goods they offer for sale.
Forced labor and human trafficking can take many forms, including child labor. CosmoExperience and its affiliated entities doing business in California (collectively, "CosmoExperience") maintain a zero-tolerance policy toward forced labor, child labor, and human trafficking in the manufacture of all products offered through our platform.
CosmoExperience operates as a B2B sourcing gateway that curates and connects international wholesale buyers with Brazilian beauty brands. Accordingly, our direct supply chain consists of the beauty brands we represent and their contract manufacturers. The commitments set out below apply to every brand onboarded to our platform.
To be represented on CosmoExperience, brands and their contract manufacturers — in Brazil and elsewhere — are expected to operate in a manner that respects the rights of people and to abide by CosmoExperience's Supplier Code of Conduct. This Code of Conduct requires that represented brands and their contractors not engage in any labor practice that violates the laws and regulations of the country where the products are manufactured or assembled, and not maintain any unsafe or unsanitary working conditions. Consistent with applicable Brazilian labor law and internationally recognized standards (including the core conventions of the International Labour Organization), the Code provides, among other things, that our brands and their contractors may not use or support child, indentured, involuntary, or prison labor in the manufacture of any product offered through our platform.
The CosmoExperience Supplier Code of Conduct is an integral part of our brand representation agreements and onboarding terms.
Represented brands and their contractors must maintain written records evidencing compliance with the provisions of the Code of Conduct and must make those records available to CosmoExperience upon request.
Because CosmoExperience curates brands specifically for export to international markets, we require every brand on our platform to hold Brazil's principal certifications and licenses (including, where applicable, ANVISA registration) and to be able to provide the regulatory documentation required for each target market. Our verification process may include requesting a copy of a third-party audit — announced or unannounced — evidencing compliance with the Code of Conduct, including its child- and forced-labor prohibitions. Where a brand or its manufacturer holds independent ethical, social, or fair-trade certifications, we treat those certifications as part of our verification record.
CosmoExperience's sourcing and account-management staff receive periodic training on the Supplier Code of Conduct, which includes updates on, and discussion of, child- and forced-labor laws and their importance when sourcing goods for international distribution.
Any CosmoExperience employee who fails to abide by the forced- and child-labor provisions of the Code of Conduct will be subject to disciplinary action, which may include termination. CosmoExperience may suspend or terminate its representation of any brand found to be using child or forced labor to produce products offered (or intended to be offered) through our platform. Such a brand may also be liable for damages resulting from breach of its agreement with CosmoExperience.
